1. Introduction

Framova is committed to providing a safe, ethical, and legal platform for creative professionals. By using Framova, you agree to comply with this AUP. Violations may result in account suspension, termination, content removal, or legal action.
2. Prohibited Content
2.1 Illegal Content and Activities
Users must not create, upload, or share content that:
- Violates federal, state, local, or international law
- Facilitates illegal activities (drug trafficking, money laundering, fraud, etc.)
- Violates intellectual property rights (copyright, trademark, patent, trade secrets)
- Involves unlicensed commercial use of copyrighted material
- Constitutes identity theft, fraud, or impersonation
- Facilitates hacking, unauthorized access, or cybercrimes
- Involves blackmail, extortion, or coercion
2.2 Violence and Harm
Users must not create, upload, or share content that:
- Depicts graphic, realistic violence, gore, or severe injury
- Glorifies or promotes violence or terrorism
- Provides instructions for self-harm, suicide, or violence against others
- Threatens, harasses, bullies, or incites violence against an individual or group
- Depicts abuse of animals or encourages animal cruelty
- Contains warnings of violent events intended to cause panic
Exception: Educational, historical, or news content depicting violence in a responsible context may be permitted.
2.3 Hate Speech and Discrimination
Users must not create content that:
- Attacks or demeans individuals or groups based on protected characteristics:
- Race, ethnicity, or national origin
- Religious beliefs or lack thereof
- Gender identity or sexual orientation
- Disability or health status
- Age, marital status, or family structure
- Caste or socioeconomic status
- Uses slurs, epithets, or dehumanizing language
- Promotes discrimination, segregation, or exclusion
- Espouses supremacist ideologies or conspiracy theories targeting protected groups
- Denies historical atrocities or promotes genocide denial
2.4 Sexual and Explicit Content
Users must not create, upload, or share:
- Sexually explicit imagery or video (nudity with sexual intent)
- Child sexual abuse material (CSAM) or content sexualizing minors
- Bestiality or zoophilia content
- Non-consensual intimate imagery (revenge porn)
- Solicitation of sexual services or prostitution
- Extreme fetish content that depicts illegal or harmful acts
Exception: Artistic nudity in educational contexts (anatomy, classical art) may be permitted if clearly labeled.
2.5 Misinformation and Disinformation
Users must not create content that:
- Spreads deliberate falsehoods intended to deceive (disinformation)
- Makes false health claims (e.g., unproven cancer cures, vaccine hoaxes)
- Promotes election interference, voter fraud claims, or false voting instructions
- Fabricates or misrepresents scientific research or conspiracy theories
- Uses deepfakes or manipulated media to impersonate real people without disclosure
- Spreads panic-inducing false claims about disasters, disease outbreaks, or emergencies
Note: Satire, parody, and opinion are permitted if context is clear.
2.6 Impersonation and Identity
Users must not:
- Impersonate real people, organizations, or institutions without consent
- Create content claiming false identity, credentials, or authority
- Misrepresent affiliation with brands, celebrities, or public figures
- Use others' names, likenesses, or voices without permission (unless for fair use, parody, or news)
- Fabricate testimonials or endorsements
2.7 Intellectual Property Infringement
Users must not:
- Use copyrighted images, music, logos, or text without license or permission
- Create thumbnails featuring trademarked logos without authorization (unless for commentary or fair use)
- Use celebrity likenesses without consent or proper licensing
- Plagiarize or copy substantial portions of existing creative works
- Violate rights of publicity or personality rights
Exception: Fair use, parody, news commentary, and educational use may be permitted in limited contexts.
2.8 Spam and Harassment
Users must not:
- Send unsolicited bulk messages or emails
- Post repetitive content to spam forums or platforms
- Harass, threaten, or bully other users
- Engage in coordinated harassment campaigns
- Dox (share private information) or threaten others
- Spread malware, phishing links, or malicious code
2.9 Malware and Technical Threats
Users must not:
- Create or distribute malware, ransomware, viruses, or worms
- Attempt to hack, crack, or circumvent Framova's security
- Launch denial-of-service (DDoS) attacks
- Inject malicious code into Framova or related services
- Create content designed to exploit browser vulnerabilities
- Collect data without authorization (web scraping, credential theft)
3. Platform-Specific Policies
3.1 YouTube Compliance
Since Framova is designed for YouTube thumbnails, all content must comply with YouTube's Community Guidelines:
- No clickbait that fundamentally misrepresents content
- No thumbnails using misleading emotional manipulation (e.g., fake death hoaxes, fabricated controversies)
- No thumbnails violating YouTube's advertiser-friendly guidelines
- No impersonation of YouTube staff, verified creators, or celebrities
- No content promoting illegal or dangerous activities

3.2 Platform Terms Compliance
Thumbnails created with Framova must comply with the terms of service of the platforms they target:
- YouTube: Community Guidelines, advertiser-friendly policies, brand safety
- Twitch: Community Guidelines, creative content policies
- TikTok: Community Guidelines, brand safety
- Instagram: Community Guidelines, advertiser policies
- Other platforms: Users are responsible for verifying compliance
3.3 Brand Safety and Commercial Use
Users who create content for brands or sponsors must:
- Obtain explicit written permission before using a brand's logo, name, or likeness
- Comply with the brand's content guidelines and brand safety standards
- Not modify or distort brand assets in a way that damages reputation
- Clearly disclose sponsorships or partnerships (FTC disclosure requirements apply)
4. Prohibited Conduct
4.1 Account Abuse
Users must not:
- Create multiple accounts to evade suspension or bans
- Share accounts with unauthorized users
- Sell or transfer accounts
- Use automated scripts or bots to manipulate credits or features
- Exploit service vulnerabilities or bugs
- Attempt to gain unauthorized access to other accounts or data
4.2 Manipulative Practices
Users must not:
- Artificially inflate engagement metrics (likes, views, comments) through bots or fake accounts
- Engage in follow-for-follow schemes or engagement pods
- Use deceptive SEO or keyword stuffing in thumbnails or metadata
- Manipulate YouTube's algorithm through misleading practices
- Artificially suppress or hide competitors' content
4.3 Abuse of Service Resources
Users must not:
- Intentionally overload Framova's servers or API
- Use Framova credits for non-thumbnail purposes (e.g., generating unrelated artwork)
- Exploit free trial credits fraudulently (e.g., multiple signups to accumulate free credits)
- Use high-tier models (Pro) for high-volume batch generation without prior approval
- Attempt to reverse-engineer Framova's AI models or fal.ai models
5. Sensitive Content Guidelines
5.1 True Crime Content
Thumbnails featuring true crime topics are permitted if:
- Content respects victims and their families
- No gratuitous gore or exploitation of suffering
- Accurate representation of cases (no false accusations)
- Appropriate warning or content label
5.2 Politics and Social Issues
Thumbnails discussing politics and social issues are permitted if:
- No incitement to violence or illegal activity
- No promotion of extremism or hate movements
- Fair representation of opposing viewpoints
- Clear distinction between opinion and fact
- No voter suppression or election interference messaging
5.3 Health and Medical Claims
Thumbnails related to health/medicine must:
- Not make unproven medical claims
- Not promote illegal medical treatments
- Not discourage vaccination or legitimate medical care
- Clearly distinguish opinion from medical fact
- Comply with medical advertising regulations
5.4 Conspiracy Theories
Thumbnails promoting conspiracy theories must:
- Not advocate violence or illegal action
- Not target vulnerable groups
- Clearly label as speculative or opinion (if applicable)
- Include evidence-based counter-information where appropriate
6. Enforcement and Violations
6.1 Violation Reporting
Framova users and third parties can report violations by:
- Clicking "Report" on any thumbnail or user profile
- Emailing abuse@framova.cc with details and evidence
- Using the DMCA/copyright notice form at framova.cc/dmca
- Contacting law enforcement for illegal activity
6.2 Investigation Process
When Framova receives a report:
- We review the reported content within 48 hours
- We assess compliance with this AUP and applicable law
- We may contact the user for context or clarification
- We make an enforcement decision
- We notify the reporter and user of the outcome
6.3 Enforcement Actions
Based on violation severity and history, Framova may:
Warnings
- First minor violations (accidental, easily remedied)
- Formal notice via email
- Request for content removal or modification
- 7-day correction period
Content Removal
- Violation confirmed but user account otherwise good standing
- Content deleted within 24 hours
- Account restrictions may apply (no new uploads for 7 days)
Temporary Suspension (7–30 days)
- Repeated violations or moderate infraction
- All account features disabled during suspension
- User may appeal after suspension ends
Permanent Termination
- Severe violations (CSAM, terrorism, violence)
- Repeated violations after warnings and suspension
- Fraud or payment abuse
- Account deleted, content archived for legal compliance
- User banned from creating new accounts
Law Enforcement Reporting
- CSAM or illegal content reported to National Center for Missing & Exploited Children (NCMEC) and law enforcement
- Terrorism or violent threats reported to relevant authorities
- Fraud or financial crimes reported as applicable
6.4 Appeal Process
Users who believe their account or content was wrongfully removed may appeal by:
- Emailing appeals@framova.cc with details within 30 days of action
- Providing context, evidence, or explanation
- Waiting for review (3–7 business days)
- Receiving written decision
Appeals are reviewed by a separate team. If the appeal is successful, the account or content will be restored.
7. Third-Party Provider Compliance
7.1 fal.ai Compliance
Framova uses fal.ai for AI image generation. Users must comply with fal.ai's Terms of Service and Acceptable Use Policy:
- No attempts to generate CSAM or illegal content
- No attempts to generate misinformation, deepfakes, or non-consensual intimate imagery
- No attempts to generate content that violates copyright or trademark
- No reverse-engineering or model extraction
Violations may result in account suspension on both Framova and fal.ai.
7.2 YouTube Compliance
Framova facilitates thumbnail creation for YouTube. Users must:
- Comply with YouTube's Community Guidelines
- Respect YouTube's monetization policies (if applicable)
- Not engage in click fraud, view manipulation, or algorithm manipulation
- Honor YouTube's content ID and copyright systems
8. Child Safety
8.1 Age Restriction
Framova is not intended for users under 18. Users must not:
- Create content sexualizing minors (even without graphic imagery)
- Share personal information of minors
- Solicit contact or meetings with minors
- Create grooming content or predatory behavior
8.2 CSAM and Exploitation
Framova has zero tolerance for:
- Child sexual abuse material (CSAM) in any form
- Grooming or solicitation of minors
- Exploitation of minors for sexual content
Any suspected CSAM will be immediately reported to NCMEC and law enforcement.
9. Copyright and DMCA
9.1 Copyright Infringement
Framova respects intellectual property rights. Users must not:
- Use copyrighted images or music without license
- Violate fair use (transformative use, criticism, news reporting)
- Create derivative works that infringe copyright
9.2 DMCA Takedown
Copyright holders may submit takedown notices via:
- framova.cc/dmca
- Email: dmca@framova.cc
- Include: specific infringing content, copyright registration, sworn statement
Framova will:
- Investigate within 48 hours
- Remove infringing content
- Notify the user
- Track repeat infringers
9.3 Counter-Notices
Users who believe a takedown was incorrect may file a counter-notice:
- Include: specific content, reason for counter-notice, declaration under penalty of perjury
- Submit to dmca@framova.cc
- Provide contact information and consent to jurisdiction
Framova will reinstate content if the counter-notice is valid and the copyright holder does not take legal action within 10 days.
10. Special Circumstances
10.1 Parody and Satire
Parody and satire are permitted and protected under fair use, provided:
- The intent is clearly comedic or critical
- Context makes the parody obvious
- The original work is not presented as authentic
- No defamation or false statements of fact
10.2 Commentary and Criticism
Criticism of public figures, brands, and media is permitted, provided:
- Intent is to comment, criticize, or analyze
- No defamation (false statements of fact)
- No incitement to harassment or violence
- Fair and balanced representation
10.3 Educational Content
Educational use is permitted for:
- Teaching, research, or training
- Historical documentation
- Demonstrating techniques or concepts
- Fair use of copyrighted material (limited and transformative)
10.4 News and Current Events
Reporting on news and current events is permitted, provided:
- No false information or deliberate distortion
- Respect for victims and their privacy
- No incitement to violence or harassment
- Compliance with journalistic ethics
11. User Responsibilities
By using Framova, you acknowledge that you are responsible for:
- Understanding and complying with this AUP
- Complying with all applicable laws and regulations
- Obtaining necessary permissions and licenses for content
- The legality and ethics of your creations
- Monitoring your account for unauthorized activity
- Reporting violations or suspicious activity
12. Changes to Acceptable Use Policy
Framova may update this AUP to:
- Reflect changes in law or platform policies
- Adapt to emerging harms or abuse patterns
- Improve clarity and enforcement
Material changes will be announced via email and in-app notification. Continued use constitutes acceptance of the updated AUP.
